Selling A Home

Staten Island Real Estate Attorney serving sellers

Guiding NY clients through the process of selling a home

When you are selling a home, there are many factors to consider and variables you may face. Once you have found a buyer, you should consult and retain an attorney to protect your rights through the process and ensure that your interests are met when you finally hand over the keys. Though you may be selling your home for a variety of reasons, it is important to have someone help you navigate the process. If you need a dedicated and effective real estate attorney, you should contact Marc Scollar, Attorney at Law.

The Contract

When you are selling a home, the first step is to enter into a contract. The contract will allow you to review the terms and accept or deny the offer. It is in your best interests to contact an attorney to review the contract or help draft it to ensure that your legal rights and needs are met. Our firm has over 25 years of experience helping clients across NY through the contract process.

Home Inspection

After a contract is signed, the buyer will have the opportunity to have a professional home inspector assess the property for any unknown issues. This usually happens within a few days after signing the contract. As the seller, you may be asked to address issues with the house that you nor the buyer originally knew about when entering into the contract. It is important to have an attorney review the requests and ensure that you are not being taken advantage of by the seller and their representation.

The Closing

Once the buyer successfully obtains a mortgage, if needed, both parties will engage in the finale of the process, the closing. At this point, all outstanding issues should be addressed and satisfied to the liking of all parties. While you get ready to hand over the keys, the buyer will have one more opportunity to walk through the home and ensure that nothing has changed since the original home inspection. Once you attend the closing, you will sign the closing statement authorizing the purchase of your home and the money to be transferred. At this point, it is time to exchange the keys.
